Article 1: Purpose and acceptance
1.1 Purpose:
These Terms of Use define the rules for accessing and using the eyhop mobile application, hereinafter referred to as the Application, available on iOS and Android.
The Application allows users to create virtual outfits using artificial intelligence tools and share them with a community.
1.2 Acceptance:
- By downloading, installing, or using the Application, you fully accept these Terms of Use.
- If you are a minor under the age of 16, you declare that you have obtained parental consent in accordance with the General Data Protection Regulation.
- These Terms of Use are available in English and can be accessed at any time at eyhop.com/en/terms-of-use.
1.3. Modifications:
We reserve the right to modify these Terms of Use at any time. Users will be informed of any changes via a notification in the Application or by email sent to the address linked to their account.
Continued use of the Application after any change constitutes acceptance of the updated Terms of Use.
Article 2: Registration and user account
2.1 Account creation:
- Registration is free and requires a valid email address.
- You are responsible for keeping your login details confidential. Any activity carried out under your account is your responsibility.
2.2 Minimum age:
The Application is intended for users aged 16 or older. Minors must obtain permission from a parent or legal guardian.
2.3 Account deletion:
- You can delete your account at any time through the Application settings.
- Deleting your account results in the permanent loss of all your data, including created outfits, history, and comments.
Article 3: Features and services
3.1 Free features:
The Application provides the following features free of charge:
- Account management. Access limited to one user profile.
- Digital wardrobe. Storage limited to 30 items, including clothing and accessories. Beyond this limit, the user must subscribe to a paid plan to add new items.
- Import. Photos can be added via the camera, the gallery, or from websites.
- Editing tools. Photo editor with automatic background removal.
- Colorimetry. Basic analysis.
- Planning. Advanced planning with usage statistics.
3.2 Subscriptions:
The Application offers two paid subscription plans with extended features:
- Essential subscription. Price: €4.99 per month or €59.88 per year.
- Premium subscription. Price: €7.99 per month or €95.88 per year.
3.3 Free trial:
- The subscription renews automatically at the end of the trial period unless canceled at least 24 hours before it ends.
- No refund is possible once the subscription has been activated, except where a right of withdrawal applies as described in Article 5.
3.4 Payments:
- Payments are processed exclusively through Apple Pay for iOS and Google Pay for Android.
- The subscription fee is charged in a single payment at the beginning of each billing period, monthly or yearly.
- All prices include applicable taxes.
- No refunds are granted outside the cases provided by law, such as the right of withdrawal.
Article 4: Intellectual property
4.1 Application content:
All elements of the Application, including design, source code, AI algorithms, trademarks, and logos, are the exclusive property of JFV Nubibus and are protected by copyright and intellectual property laws.
Any unauthorized reproduction or use is strictly prohibited.
4.2 User content:
- You retain ownership of the content you upload, including photos and outfits.
- By publishing content on the Application, you grant a worldwide, non exclusive, royalty free, and irrevocable license to:
- Display, modify, reproduce, and distribute your content within the Application.
- Promote the Application, for example by using your creations in marketing communications.
- This license ends when your account is deleted.
4.3 External sharing:
You are authorized to share your creations outside the Application, for example on Instagram or TikTok, provided that you:
- Respect third party rights, such as not using protected brand images without authorization.
- Do not alter AI generated outfits in a way that changes their meaning, for example by adding logos or hateful messages.
Article 5: Right of withdrawal (subscriptions)
5.1 Legal period:
In accordance with Article L221 28 of the French Consumer Code, you have a period of 14 days from the date of subscription to a paid plan to exercise your right of withdrawal, without providing any justification.
5.2 Exercising the right of withdrawal:
To exercise this right, please send an email to contact@eyhop.com including:
- Your name and the email address linked to your account.
- A clear statement such as: “I wish to withdraw from my subscription (Basic or Premium)”. A full refund will be issued within 14 days using the same payment method.
5.3 Exceptions:
The right of withdrawal does not apply if you have used the Premium service.
Article 6: Personal data and GDPR

6.1 Data collected:
We collect the following data:
- Registration data, such as email address, name, and age.
- Payment data, processed by Apple Pay and Google Pay. We do not have access to your banking details.
- Usage data, including outfit history, interactions with the AI, and style preferences.
6.2 Purpose of processing:
Your data is used to:
- Personalize outfit recommendations.
- Improve our AI algorithms in an anonymized manner.
- Ensure the security of the Application, including fraud detection.
- Send you communications such as updates and promotional offers, unless you choose to opt out.
6.3 Data sharing
- No data is shared with third parties for commercial purposes.
- Your data may be shared with:
- Service providers such as hosting or analytics tools, under GDPR compliant agreements.
- Legal authorities when required by law, for example in response to a court order.
6.4 Your rights
You may exercise your rights of access, rectification, deletion, and objection by writing to contact@eyhop.com. Your data is retained for three years after your account is deactivated, unless a longer retention period is required by law.
Article 7: Liability and warranties
7.1 Application provided as is:
The Application is provided as is, without any guarantee of perfection or continuous availability. We do not guarantee that:
- AI recommendations will always meet your expectations, for example an outfit that is not suitable for an event.
- The Application will be free from bugs or interruptions, whether planned or unplanned.
7.2 Limitation of liability:
Our liability is strictly limited to the total amount paid by the user over the last twelve months. We exclude any liability for:
- Indirect damages, including loss of profits, damage to reputation, or loss of data.
- Malfunctions of third party services such as Apple Pay, Google Pay, or hosting providers.
- Fraudulent use of the Application.
Article 8: Security and fraud
8.1 Security measures:
- Passwords are hashed and salted to prevent data breaches.
- Authentication is performed using secure tokens.
8.2 Fraud prevention:
Suspicious accounts, such as those using disposable email addresses or showing abnormal activity, may be suspended without prior notice. In the event of confirmed fraud, for example the use of multiple accounts to bypass free usage limits, we may apply the following measures:
- Immediate account suspension.
- No refund of any ongoing subscriptions.
Article 9: Termination and suspension
9.1 Grounds for termination:
We may terminate your account without prior notice in the event of:
- Violation of the Terms of Use, for example illegal content or harassment.
- Prolonged inactivity exceeding twelve months.
- Abusive behavior, including spam or fraud.
9.2 Effects of termination:
- Permanent loss of all your data, with no possibility of recovery.
- No refund of any ongoing paid subscriptions, regardless of the reason for termination.
Article 10: Disputes and governing law
10.1 Dispute resolution:
In the event of a dispute, you must first contact us by email at contact@eyhop.com in order to seek an amicable resolution. If no agreement is reached, the dispute will be submitted to the competent French courts.
10.2 Governing law:
These Terms of Use are governed by French law and European Union law.
Article 11: Miscellaneous provisions
11.1 Changes to the Terms of Use:
We may modify these Terms of Use at any time, with thirty days’ notice provided through a notification in the Application. Continued use of the Application constitutes acceptance of the updated Terms of Use.
11.2 Severability:
If any provision is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
